Middleborough Conservation Commission votes unanimously to approve response to Open Meeting Law complaint. The Commission's September 23 vote addressed a challenge from residents Patrick and Pamela Caffrey questioning whether the September 3 agenda's "Discussion" label provided adequate notice that applicant Shane Oates's withdrawal letter would be discussed. Attorney Hayley Reifeiss of KP Law defended the posting as sufficiently specific under Open Meeting Law standards, arguing that materials reasonably flowing from posted agenda topics need not be detailed in advance.
Reifeiss will submit the response to the State OML Division by deadline, with the Caffreys retaining a 30-day appeal window.
